Just read a press release re a patent infringement suit filed against INCY and Synteni by AFFX.. The release is rather curious; AFFX CEO sounds almost apologetic about bringing suit. On the other hand, from what I know about this issue, which isn't much, AFFX seems to have a lead in the gene chip array area but has no near-term prospect for earnings. Was AFFX looking for buyout/equity infusion from INCY and is now a bit P.Oed about the acquisition of Synteni?

Any relevant information would be helpful.
