Menahel, this is definitely not one of those cases where there is a clear cut shareholder grievance. If you look at the group as a whole, they all got slaughtered. JMAR announced a long time ago that they were considering private placements to raise money (disclosure). Why not sue the Dow Jones for the market crash earlier in Oct., or the swiss. JMAR cannot be faulted for raising money. Anytime a company raises money thru a secondary offering the risk of decline is there. Given the crash of technology issues and the Korean fiasco, how can you say the total decline is due to the swiss. They disclosed the info on the swiss in an SEC document. Where is your case?
