I believe Ballmer was referring to upholding the letter of the law and not on what effect it will have on the company. That is, if we remove all IE files then we get slammed for not complying with the spirit of the law. On the otherhand, if we just remove the IE icon, then we get slammed for not complying with the letter of the law. This is indeed a lose-lose situation. However, this is a legal, and perhaps PR issue, but certainly not a financial one. For shareholders, all that matters is the bottom line (mostly) and Microsoft will win regardless of which is chosen above (win-win) because they have a better product and are able to give more to the customer of what they want.
