I have always maintained that is the really key point for Toshiba:

Under the revised proposal, Toshiba could buy back equity from INCJ and DBJ later, the people said.

It is what Toshiba did for Sandisk and what they have always wanted assurances that they could do in the future. It might be a delusional wish, since they are in worse shape than Sandisk was. Although the NAND business is in better shape today than it was back in 2009 and should throw off more cash.

At any rate, I am just guessing here that if WDC-KKR had agreed to allow Toshiba to buy back their share of the business a few years down the road (if feasible), this whole thing would have been settled months ago.
