In light of most recent rumors, it may be instructive to review WDC's statement of October 10 in its Q&A related to Toshiba:

Western Digital believes the evidence in arbitration will show that Toshiba is trying to exclude SanDisk from Fab 6 to coerce SanDisk into waiving its consent rights.

If the current rumor is to believed - that consent rights would be waved in exchange for Fab 6 participation - this would indicate that Toshiba has succeeded in its coercion.
