Some additional color on the current rumors can be found in the last conference call. Milligan stated:

The negotiations regarding the second investment tranche for Fab 6 are ongoing. Just as we did during the negotiations for the first investment tranche, we intend to jointly participate in the investment, and we are agreeing to all good-faith commercially reasonable terms proposed by Toshiba. However, we will not agree to terms such as SanDisk unilaterally waiving or negating its consent rights as a condition to participate, which is what Toshiba has proposed.

The rumor includes the following information regarding the settlement:

WD would withdraw arbitration suit, in return Toshiba would continue its agreement with WD to jointly produce chips at its plant in Mie prefecture

This is contrary to Western Digital's public statements regarding negotiations, and more reason to treat the report as bogus. While Western Digital could very well reverse their position, only a public statement from WD should be trusted.
