So where to things stand now with the Toshiba cash infusion? Toshiba can just sit back and relax, and not worry about the results of arbitration. If they can't sell to Bain, they don't need to sell period. But there is nothing to stop Toshiba from partnering with Bain on Fab 6 and beyond. While consent rights are clear, and I expect arbitrators to uphold, I do not expect them to side with WDC on the Fab 6+ issue. WDC's 2020+ problem remains.
