When reading fake news stories, as published by Bloomberg last night, only two items need to be remembered:

(1) WDC says they will not drop consent challenge in exchange for Fab 6 participation, and

(2) Toshiba has denied that they have ever asked WDC to do so.

Yet each of these mythical "almost" settlements involves dropping consent challenge in exchange for Fab 6 participation.

Consent, or the sale to Bain, no longer matters. It is now all about participation in Fab 6 and beyond, and Toshiba is under no contractual obligation to allow WDC in. There are many other willing players with the money to do so.

While some may say that SanDisk IP is required in Fab 6 production, Toshiba has the right to use it, whether or not WDC is a participant. The only question, because of redacted terms, is how much money is required to do so. There is no prohibition against use.
