There was no doubt as to the merit's of WDC's consent rights. Toshiba was never in a great position with respect to this, but had ALL the bargaining power to get the challenge dismissed. WDC had no choice but to drop their claim, as their access to future needed supply was being blocked. They negotiated with WDC because they wanted the claim dropped, and negotiated from a position of strength. WDC negotiated from a position of weakness, because they needed the supply.

Although I have repurchased a portion of what was previously sold, the company no longer has the long term upside it had a year ago, and I will never reestablish the full position. This is primarily because of too many cooks in the kitchen, and the involvement of Apple in the deal. This will come back to haunt WDC at some point in time, in some form that will affect future margins and earnings.
