Toshiba got everything they wanted. WDC survived, but is crippled for life.

It isn't a foregone conclusion that they are "crippled for life". It depends on what rights Hynix will have. That part isn't clear to me, based on the small part I've read. If WDC will be crippled, then so will Toshiba. That is why I am hesitant to agree with your assessment. It would make no sense. Nor would it make any sense to allow Bain to sell their share to anyone they want without Toshiba or WDC getting some sort of veto power. I find it hard to believe that those topics weren't thoroughly discussed during their long negotiations.
