What would be illegal about ordering a first strike on NK? As CINC, surely he should have the right to make that decision and he doesn't have to take anyone's advice on it.



They are not the kind who will just say, "Uh, OK Mr. President, whatever you say" when it comes to launching an arbitrary nuke.

They'd never talk to the President. Orders would be transmitted to them. They don't have a lot of time to decide to follow the order or not. Are you sure they'd refuse to accept a valid order that came in at 3:30 AM someday? I'm not so sure.
