known as "Fruit Of The Poisonous Tree Doctrine", and within that, one of the most poisonous fruits is a lying "eyewitness". Many an innocent man has been "hung" on the say so of one or more of these kind of "trees".
Eyewitness testimony whereby even in the case of an "honest" tree has made many a mistake in the ID process of a defendant. Before the advances of technology in forensics, all the courts had in many cases was the testimony of one or more eyewitness, along with some circumstantial evidence with which to convict or exonerate an accused.
It should be no surprise that most convictions, in the past, as well as now, have been attained by "circumstantial evidence".... In most cases a defendant leaves his "calling card" every time....
Experts in the field of forensics are the eyewitnesses. This is a much more accurate means of identifying a suspect.
We could free 3/4 of this country's most violent criminals if jurors could only consider the testimony of a "real" eyewitness.
There would also be No deterrent to most crimes. You are right in saying our courts are a long way from the laws of God, but I would not want to be tried for a crime in ant other country, and I would not want to be convicted of any crime based on the say so of one or two "eyewitnesses"...And lastly if we take the process of forensics, as a way of identifying a criminal, out of the court system, then this country would be thrown into the abyss of crime...
Maybe that is why God made us all so "unique"...giving us our own fingerprints, and DNA, which no two people in the world can have.Not even identical twins which do have the same genetic makeup, and whose fingerprints are very similar.....
It is a prosecuting attorney's worst nightmare if all he/she has is an eyewitness..but thank God, that is usually never the case anymore.....and a defense attorney's dream come true...
The state has a most difficult burden to prove the guilt of an accused. As well it should be...but that burden becomes impossible without circumstantial evidence..."the suspects calling card"
