Riley,

As an attorney, I find it highly suspicious that Randall Baker, a non-lawyer, is the spokesman for Magellen and is speaking to callers about the specifics of their complaint.

If a lawsuit really did exist against Olympus and if a reputable and competent firm was handling the matter, they would never allow a non-lawyer to speak on their behalf. The press release would have named the main lawyer on the case as the contact person or at least a PR man with a genuine knowledge of the facts and a list of carefully scripted responses approved by counsel.

The firm would want a lawyer to be handling any and all inquiries in order to best manage what information is being given out. They would never allow some hack broker to spread a constantly changing and uncertain story. This is because what Baker says in these conversations with Olympus shareholders may be useful as evidence against Magellen in any pending or considered litigation. If he misstates facts or defames Olympus, even if by accident, he could be damaging his client's legal position. Therefore, I would be surprised if a lawsuit has actually been filed, and if it has, the unprofessional handling of this matter would indicate that Olympus has nothing to worry about.
