The only reason Comey reopened the email investigation was due to the NYPD and FBI field offices discovery of Weiner's/Uma laptop containing Classified information. He got out in front of it and pretended to investigate it and then made his famous speech (Hilllary is guilty as sin, but didn't mean harm so no reasonable prosecutor would prosecute the case. )

What he should have done was request DOJ convene a Grand Jury. However he didn't because that would have absolutely fried Hillary's chances of becoming president and even placed her in prison.
