Yes it is but republican states didn't set up exchanges. When the Supreme Court looked at this problem they didn't know how to handle it. Every republican governor was violating the law. One suggested they rewrite the law to give states more time to set up exchanges, another said it wasn't their job to rewrite the law. So what did they do? They did nothing.

SCOTUS refused to enforce the law so now states are violating other court orders such as in Pennsylvania. They did this to themselves. They put party before country and the rule of law.
