It is an interesting question.. legally speaking.. based upon my reading, Sinovel is the first Chinese company to have been found criminally guity for IP theft, so that kind of sets a precedent in itself.

But since the criminal fine will possibly equate to some $4-5 Billion, and the Chinese gov't is reportedly an 18% shareholder, the US could justify applying those tariff fees as criminal fine payments...

My question is whether Bejing will decide to dissolve Sinovel? They have quite a few wind turbines in place there, and if the company disappears in a BK, the question remains as to who will service those emplaced turbines..

If some other company decides to do so, and those turbines are using AMSC control systems, one would think that would make them liable.

I would be happy if they negotiate a $200 million payment.. It would aid AMSC's financials tremendously.
