In this country we do not presume guilt in the absence of evidence

We also do not assert that there is no evidence prior to the conclusion of the investigation, at least not reasonably. Even then, there might have been evidence that was not made public. You are on very weak grounds claiming no evidence until and unless the investigation says it found no evidence.
