Seems to me, Homeowners Association would have to take this guy to court and challenge the trade mark IF the building name is legally registered.. Looks like something is off there.. May be Building name is just a name and not a legal entity ? Because you did say that Hotel name and the Trade Mark is the same name as Building Name..

Legally put him on a spot to settle for some nominal sum to pay for his costs..

This would be similar to you and I registering popular business name as domain name in the early days of the web or variation of it and then trying to flog it to the company when they try to do it and find that some one has already done that.. Lots of stories about this out there on the web..
