I do not see it as a flimsy distinction at all.

A design patent is embodied in the look-feel/utility/user-interface of the phone. Apple is arguing that Q's patents are already embodied in and delimited by Q's silicon. Apples-oranges.

I am not aware of any other IP holder who sells a tangible part which embodies its IP, then strips away (gives up) any claim to the IP in that part, only to re-assert that claim in a separate license wherein the royalty is computed on the basis of the construed "market" value of the device which incorporates that part. I could be remiss, but I cannot think of any. Intel does not. Microsoft does not...
