You misunderstand my point. The issue is not whether you should be allowed to recapture above and beyond your investment. Of course you should. The question is how. Software is licensed to run on a machine. Software royalty often does vary per the machine, as the royalty is based on the expected number of users (seats) for that machine, which is rational. Drug prices do not vary based on who the patient is, his net worth etc. Q can capture the exact same amount of royalties by shifting and applying the royalty to the parts which embodies its IP, whether sold by it or anyone else (Intel, Mediatek, Spreadtrum, captives etc.) As to the argument that this somehow penalizes low priced handsets, not really, because higher performance modems will always be priced higher than low performance ones.
