I think collecting on the device level (when it's a cellphone) is both fair and practical in Qualcomm's situation. The main thrust of Qualcomm's SEPs are related to generated the mathematically sophisticated patterns of electromagnetic waves used to communicate with towers; but in that effort, the silicon modem (which is designed with the related mathematics in mind but could also in theory be a sufficiently fast commodity CPU running some custom software or an FPGA) is a circumstance of the implementation rather than an the essential element of the actual patented idea. I think Apple's representation of the situation has been far more distortive, aggressively deconstructive, and self serving (especially in its definition of fairness) than Qualcomm's methods which are more practical and fair to lower BOM players in the ecosystem that make less intensive use of patents.
