Nonsense. The two are not comparable at all. D'Souza knew exactly what he was doing. He not only went way over the limit, he used third parties to do it. And then he tried to cover it by lying to the candidate when she asked him about it.

So it was a deliberate act. Planned and executed in a deceitful and illegal way. Calling it a 'mistake' is just a lie and a misrepresentation of the facts..
