A Supreme Court decision in favor of Schlumberger (published today) may have a very positive impact on AMSC. It seems that Schlumberger or one of its subsidiaries had patents on certain equipment or component parts that were then used by a foreign company selling to others within and outside the U.S. An earlier case limited compensation from patent infringement to products imported into the U.S. on the grounds that you couldn't sue a foreign company for patent infringement on devices sold outside the U.S. This latest case, with the 7-2 majority opinion written by Clarence Thomas, says you can sue in the U.S. for patent infringement on U.S. patents used outside the U.S. for sales outside the U.S.

This could be a really big deal for AMSC, and for many other companies as well (e.g., Qualcomm).

The case is WesternGeco v. Ion Geophysical. The decision broadens the application of Sect. 284 of the Patent Act to cover damages accruing overseas from U.S. patents.
