Not sure I agree.. Recall that this case is a Federal Criminal matter, not a lawsuit.. Sinovel could have taken a plea bargaining deal before the conviction, but they chose not to..

Not much room for a settlement, especially on the damages, since they have already been specified in the DOJ announcement..

To alter those facts would disadvantage AMSC, diminishing their status as a victim.. So the most they could do is negotiate on the fine, which AMSC would not receive anyway..

Worst case scenario I see is minimal 1X damages as the fine..

I don't think they can prevent the public release of the sentence either.. or at least it would be highy unusual to do so..
