There are several possible outcomes, before or after sentencing. If the sentence is issued on schedule, Sinovel still can file an appeal, through they will probably have to post bond in order to do so. If they appeal, then they can also start negotiating on compensation. It would be a travesty of justice if AMSC were awarded merely the cost of lost business, even the cost of lost business, including interest on the unpaid amount. The amount to be paid to AMSC also might be conditioned on the resolution of the lawsuits currently before Chinese courts. Here is where some face saving could occur. How much would Sinovel and/or the Chinese government like to see all these lawsuits in China dropped, in exchange for a reasonable payment (e.g., $3 billion) to AMSC, plus legal fees spent by the U.S. in prosecuting the federal case? How much would the U.S. government be willing to sacrifice for an agreement with the Chinese government to reimburse ALL individuals or firms in the U.S. that have experienced some form of intellectual property theft? How much would China be willing to sacrifice in return for not losing its membership in the World Trade Organization, owing to its routinely ignoring the respect for IP demanded by that organization? These are just a few of the issues that dedicated and knowledgeable public servants could bring to the table. The main requirement is that the government really wants to resolve the issues and really has staff that are sufficiently experienced to bring about a satisfactory resolution. I still have my doubts, but I can wish. Art
