You are completely wrong in your inference of what this litigation relates to a little research might have helped. The following paragraph is completey wrong

"Unjust enrichment means that AT&T is arguing that if FTEL can't sell long distance and not have to pay for the infrastructure to provide it, as AT&T has. If FTEL gets the benefits of being a long distance telephone provider without paying for the infrastructure cost, like AT&T, then FTEL is unjustly making money."

This is stated as fact. I would take care when trying to state what the company is fighting especially in a public forum.
