I have to admit.. I'm UTTERLY at a loss as to how the Judge ruled that the Maximum fine was $1.5 million..

I'm still digging through the Federal Sentencing guidelines for that one..

First of all, Sinovel acted like a criminal organization, engaging in corporate espionage against AMSC and actually paying someone to steal their technology with Sinovel corporate funds.

The amount of damages was in excess of $400 Million which should have added 24 points. The culpability score should have been at least 8 out of 10.. But really it should have been 10 out of 10 as Sinovel did not immediately halt it's use of the stolen IP, but instead, continued to incorporated it into new Wind Turbine installations to the tune of $15-25 Billion in pecuniary gain to Sinovel.

They lacked an effective compliance department, which would have acted to prevent further use of the stolen IP.

In sum, they should have faced the maximum fine x maximum multiplier.. At least $1 Billion.. even if I misunderstood the "damages X 4x multiplier..

I find it pretty d*mn disgusting that AMSC gets more justice from the Chinese Civil litigation courts, than from our own Federal Criminal courts..

That's just embarrassing..
