I agree, Jerry. Microsoft isn't looking to good for this case, but it looks to me (though I am not expert) like they have a lot of solid grounds for appeal.

I don't get why Lessig remains on the case. If there is any question of his impartiality, I would think that the judge would boot him to avoid all the headache that his presence would cause.

As for the judge, why is he being so openly hostile towards Microsoft, or is this sort of thing common/accepted that I don't know about? Seems as though he's just adding more juice to Microsoft's appeal.
