Fitz - I agree. The statement that "good news is pending" is IMO neither unusual nor unethical. In fact, I believe it quite common for companies to state that news is pending, and an anticipated release date. After all, building this expectation is a big part of making an impact when the news does come out. Where ethics (and law) come into play however, is when the nature of the news gets disclosed in a non-public manner prior to the "official" release. Of course add the old buy-on-rumor-sell-on-news axiom and you've suddenly got a great deal of (perhaps otherwise undeserved) volatility. Anyhow, I do agree with Matty on the point that this stock has definitely demonstrated a peak-before-news pattern that cannot be denied. -R
