Since when has "interest of the industry" become a matter of concern and priority to the courts? The court's sole purpose is to enforce the law, in this case laws concerning property rights. Q's property rights are either violated or they re not. What does the interest of the industry have to do with the law?



I doubt this comes down to Q's property rights but rather how a court sees Q's FRAND obligations. The terms of which were deliberately left vague and so it will come down to how a court interprets them.

I would hope that the impact of the decision on the industry would not matter to a judge but Jeffrey has often mentioned it so I thought I would it be good to get his perspective on whether that will likely matter to a judge.
