This is, in fact, the problem with the US today; it is now ruled by a minority and none of the constitutional safeguards that were put in place by the founders work as intended.

In the House and the States, gerrymandering has often overturned the popular vote. In the Senate, 40M Californians have the same say as 750k Alaskans and what was meant as a protection for smaller states has turned into a minority rule. The electoral college has refused to do its intended constitutional role and votes along party lines - so you have presidents who assume the office without a popular vote, public service, or even a clear-cut legitimacy that they won the election (go back a few years for this one). And now you have overt meandering of USSC for political reasons without any consideration to the legitimacy of the court for impartiality.

These are huge problems that should bother everyone regardless of party affiliation. But most people end up justifying them when their side is in power. Here's a graph that succinctly demonstrates the trend and how untenable it is: Message 31716653
