That is Flynn's prerogative. And it is Dersh's to comment in the news about it. He makes a good argument. It makes no legal sense for an immaterial lie to be a crime. It would be like trying a kid for stealing a piece of bubblegum. There is no benefit to the public interest. I don’t know what your problem with Dershowitz is, but I do believe he's correct in this situation.
