Penni, I agree, and those are good points. I believe this entire debate of parental rights vs state rights is going to really heat up in the next few years.

Smoking is just one of the issues I believe we will have to deal with. But let's take smoking for example....What if the parents had a child who had a severe case of Asthma. So bad that when the parents do smoke the child is put in the hospital?

Clearly we as a society have an obligation to do something to help the child. Perhaps educating the parents is the right answer. Certainly in an extreme case removing the child should be considered.

The problem with going down this road is that too often the state goes way too far in implementing rare cases. The Child Welfare protective agency is a perfect example of an agency gone burzerk, supposedly for the good of all?? Never have the rights of tax paying citizens been so callously thrown aside then through that agency.

I don't believe it's paronoid scare mongering to say...Our rights as parents are being steadily eroded in this country. Far too many people seem willing to just hand over the raising of children to the state.

State Day Care and forced volunteerism by high school kids are just the latest examples.
