You're mistakenly trying to apply Canadian legal logic of intent to the communist system which is based on perceived threat or being a cause of embarrassment to the Party.

Anyone who has been visible enough to think themselves a voluntary propagandist for China, has inevitably committed a litany of counter-revolutionary acts. Trying to become the Paris Hilton of Hong Kong in itself is worthy of the death penalty for anti-state activity.
