Vivus Shrs Up 17%; Rejection
Of Super Bowl Ad Cited

NEW YORK -- Vivus Inc.'s (VVUS) shares jumped
16.8% in apparent reaction to publicity generated by
NBC's decision not to run a TV commercial for Vivus'
Muse impotence treatment during Sunday's Super Bowl,
according to Vivus spokeswoman Nina Ferrari.

Ferrari said NBC's decision drew widespread press
coverage. NBC is a unit of General Electric Co. (GE).

PaineWebber Inc. analyst Charles Olsziewski said
another possible explanation may be that the company is
buying back stock. Vivus' shares continue to trade only
slightly above their 52-week low due to problems at a
new plant in New Jersey that caused a fourth-quarter
production shortfall.

"At these types of levels with where they are
competitively and where they will be after they get their
manufacturing woes behind them, which we expect they
will, this makes a good investment," Olsziewski said.

Ferrari declined to comment on whether the company
was buying back stock.

Vivus' shares rose 1 15/16 to 13 7/16 on volume of 2.2
million. Average volume is 1.6 million. The shares set a
52-week low of 9 11/16 on Dec. 16.
