Hate to tell you this , but John can't qualify. Further, when the IRS disqualifies him and demands back taxes and penalties, will you be there to handle his problems including audits and court? The trader status has gotten progressively tougher to achieve, not easier. The machine has only made it easier to appear like you qualify because the definition has been blurred, but who wants to take the chance if the definition comes into sharp focus? Guess who does the defining, the IRS at their convenience.
