"Loser Pays" would prevent nuisance suits. Too many lawyers (and there certainly are too many lawers) will take any case as it costs little to file a suit and there is little to lose. If the losing party were liable for the defendants legal fees people would think twice before they filed a suit that they knew had no basis (but filed hoping for a settlement). Also punitive damages are to punish the defendant, not enrich the plaintiff, so punitive damages should go to the government (and used to reduce court costs), not to the plaintiff (with a hefty % to the lawyer)
