The president could act on it. However, after doing so, if it involved war he would surely be bound to go to Congress. I don’t think Dershowitz was playing it out to that eventuality.

His point is that when presidents have discretion they cannot be impeached for exercising it.

Dershowitz is correct on this. The Court would be forced to accept this rationale because it is his constitutional responsibility to make the decision.
