I agree. This is the system in many European countries and it seems to work. I disagree on the gov getting the punitive damages. They already take almost half as punis are fully taxable. If all the money went to the gov no one would seek punis and in some cases they are justified. I believe however the courts including the appeals court in review should have broad powers to keep them in line. There is an emerging case law supportive of judges discretion to reduce jury punitive damage awards.
