A lawsuit will certainly not help you regain what you have lost. It won't help the company, and it won't pay off for you.

And I really can't see what grounds you have in the first place.

KE sold some shares and then missed the quarter? How could he have known they were going to miss when he sold?

The stock was split when management knew they would miss the quarter?
How could they have known that at that time?

They failed to warn of impending missed earnings?
Of 1 cent? Give me a break.

They failed to understand how badly the street would react to the advertising budget increase? Again, how could they know?

KE performed badly on the conference call? Sure, but it isn't grounds for a lawsuit.

A shareholder lawsuit at this time only detracts from the value of the shares you are holding. It is groundless and counterproductive. I understand your anger, but no one forced you to buy when you bought, and no one forced you to hold. The ultimate responsibility is yours.

As a person who is still holding, it makes me furious that you are starting a lawsuit. You're not helping anyone but some lawyers who don't need or deserve it. Certainly any lawyer who would bring such a specious lawsuit doesn't deserve anything but contempt.
