I took a middling deep dive into Floyd’s autopsy report. Two things struck me: the 11 ng/ml Fentanyl level and his congested lungs resulting from Covid-19 Infection.

The Fentanyl was not sufficient by itself to make Floyd lose consciousness. The toxicology reports that loss of consciousness occurs in patch-applied Fentanyl at 34 ng/ml. However, whether it acted in combination with his compromised lungs and the prone position he was in to result in a loss of consciousness is definitely an open question.

Floyd's congested lungs probably resulted in a lowering of the threshold for Fentanyl-induced loss of consciousness from the 'normal' 34 ng/ml to some unknown number. Was it 11 ng/ml as the toxicology report states? Who knows, that will be a fine battle between the State's medical experts and the defense's.

If I’m reading the report correctly, there is no evidence of asphyxiation.

It seems that the ultimate question will be whether the combination of the Fentanyl, the compromise of Floyd's respiration by the effects of Covid-19, and the prone position in which he was placed were enough to kill Floyd or whether the officer's actions also contributed to his death.

Taking him out of the prone position after he complained about his inability to breathe might have saved his life because he had not lost consciousness at that point, but that’s speculation on my part. There seems to be no question that there was no need to keep him prone as he had been subdued by then.

In any event, the autopsy report suggests that the officers have a basis for defending the charges against them. The case will not be a slam-dunk against the officers. A skilled trial lawyer who picks the right jury could win the case. If a jury should find them not guilty, the present riots will seem as peaceful as a garden party.
