I would suggest, GZ, that if someone is "protesting" at 4am in the midst of "rioters", then perhaps that "protestor" is not really a protestor? Here's another litmus test. A lawful protest must have a permit issued by the city, specific as to time and place. How many of these peaceful protestors are permitted? At 4am? Not likely that any of them are permitted, which by definition means they are NOT protestors. They are rioters.

Also, peaceful protestors don't verbally assault and intimidate police officers or other people. That's not protesting. That's the legal definition of assault.
The definition of assault varies by jurisdiction, but is generally defined as intentionally putting another person in reasonable apprehension of an imminent harmful or offensive contact. Physical injury is not required.
And then there is all the battery that is occurring, inflicted by these "peaceful protestors" on police and other people. 180 police officers have been hurt in just the last few weeks from "peaceful protestors" throwing things at them and setting off commercial grade fireworks and mortars at them. This is an armed insurrection and a riot. It's time to lower the boom on these Communist azzzholes.
In an act of physical violence by one person against another, "assault" is usually paired with battery. In an act of physical violence, assault refers to the act which causes the victim to apprehend imminent physical harm, while battery refers to the actual act causing the physical harm.
And then there is legal precedent when the 1st Amendment, which includes lawful assembly, may be restricted. It's the Brandenburg test:

The test determined that the government may prohibit speech advocating the use of force or crime if the speech satisfies both elements of the two-part test:
  1. The speech is “directed to inciting or producing imminent lawless action,” AND
  2. The speech is “likely to incite or produce such action.”
Nope. What's happening in Portland, Seattle, Chicago, and other lawless Democrat controlled cities and states is not peaceful protesting. It's rioting, looting, and revolution intended to overthrow our government and our way of life. At what point do we start fighting back and forcing our own government to stand up for our laws?
