When the news broke last night that Bill Barr’s DOJ had altered and apparently falsified evidence in the hope of painting Michael Flynn as a victim, we knew there were going to be fireworks in today’s Flynn hearing. But it turns out most of the judge’s ire was aimed at Donald Trump.
Judge Sullivan ended up asking Michael Flynn’s defense attorney if she had discussed the case with Donald Trump. She tried to invoke executive privilege, which isn’t a thing in this instance, before ultimately admitting that she’s been personally briefing Trump on the developments in the case. This is nothing short of a bombshell about Trump’s behavior. It’s not necessarily surprising, but it’s still shockingly corrupt.
At that point retired Judge Gleeson, who was appointed by Judge Sullivan to help sort out the Trump regime’s meddling in the case, announced his view that “Donald Trump has open disdain for the independence of the Justice Department.” Judge Sullivan hasn’t yet ruled, but this would seemingly end any brief shot that Flynn might have had of getting the charges against him dismissed. It also appears to be obstruction of justice on Trump’s part, but any such criminal charges against him will seemingly have to wait until after he loses the election.

Bill Barr apparently caught trying to falsify evidence in Michael Flynn case Bill Palmer | 11:45 pm EDT September 28, 2020 Palmer Report » Analysis
In the latest reminder of just how ineffective of a henchman Bill Barr has turned out to be, nearly five months after he tried to get the criminal case against Michael Flynn dismissed, the case is still intact. The courts keep ruling that Barr and his DOJ can’t throw the case out, and that the judge is free to send Flynn to prison. Now Barr has apparently gotten desperate.
Late last week, Barr’s DOJ released some internal notes from the Flynn case that were designed to embarrass the agents who investigated Flynn. This is of course going to have no impact on the Flynn case, because the judge made clear awhile ago that he’s not amused by Barr’s antics.
But now former FBI agent Peter Strzok has sent a letter to the judge, revealing that Bill Barr’s DOJ altered the notes in question, by adding incorrect dates which change the context of how the investigation played out. The mere act of altering the notes at all is a clear sign of bad faith intent, so Barr and his DOJ lose any benefit of the doubt when it comes to the question of whether they got the dates wrong on purpose.
It’s difficult to imagine anyone in the DOJ doing this without Bill Barr being involved. So it appears Barr and his underlings tried to falsify evidence with the intention of painting Michael Flynn as a victim. If the judge also sees it this way, it’ll spell the end of any faint chance Barr might have had of getting Flynn off the hook – and it could lead to criminal liability for Barr if Trump loses the election. Of course Barr is already on the hook for so many counts of felony obstruction, who’s counting?
