The Appeals Court could have dismissed the case. In fact, the losing judges in the Appeals case argue strongly in favor of dismissal. While your statement is technically correct, Sullivan knows it's in his hands and from his previous ruling and partial sentencing (before Flynn changed his mind) Sullivan is going to throw him into jail for a very long time. He even asked if Mueller considered charging him with treason. His words were very clear....a General lying to the FBI in the White House was not a normal crime.
