samson: In a class action you can join at any time up to the point where they close the accounts, which may be years from now.
There is a lawsuit thread re BRE-X, and all the legal players are mentioned there.
Usually you have to qualify for the class by losing money on trades between certain dates. SInce a discount broker merely executes trades and give you no advice your case may be against others in the food chain, such as Felderhoff etc.
In any event the lawyers will have a worked out list of who sues whom and where. Here is the legal resource thread I started.
