I think the reason is that they will take it all the way to the supreme court no matter the result
Take what to the Supreme Court? You know how often lame duck sessions of Congress have confirmed Supreme Court appointees?

It goes as far back as the John Adams administration. (He was the second president of the United States after George Washington, for those of you in Rio Linda.)

It's legal and constitutional.
