I don't think they will use Zip disks but it is possible to protect the zip disk from cloning but this can get around easily if hardware is compatible. To make cloning harder, they can put some hardware blocking mechanism in the N64DD to achieve this.

PSX proved that this is not a problem at all.

Yes indeed but I think this is a mistake. If N64 used CD when it was first released in late 1995. It should dominates the market faster then now. Acclaim had taught us a good lesson.
