Well, I took a minute to glance at the suit. It presents only a question of law, i.e., whether the defendant States violated the Constitution by having the rules changed by their respective executive officers rather than by their Legislatures?

Damn, that’s clever. No real fact-finding required. No claim of fraud being litigated. A simple yes or no answer that I think the Court can readily handle if it gets past standing.

Very, very interesting.

I lost a bit of my skepticism but still think it is an uphill battle.
