I am not a lawyer, but I have known for a long time that if one drills down to the bedrock of the law one will find out it is basically existential in nature i.e. the law is what the courts say it is, the "Paper Chase" myth not withstanding.

And if it is existential then it is all the more important to appoint wise and honorable people.

Something antithetical to Republicans.

And over the last 50 years or so, the Republicans have moved the law farther and farther away from logical decisions and into political decisions.

Even the Supreme court has operated in a very existential manner i.e. the law is what we say it is e.g. when they stole the 2000 presidential election for Bush, and then said the decision could not be used for case law.

Recently the SC voted 80 times to uphold questionable decisions favorable to the Republicans.

It seemed like Ken Starr, the Republicans "hit man" sort of started this when he moved into heretofore gray areas, trying to impeach Clinton and opened up a Pandora's box.

Since then the Republican courts have played increasingly fast and loose with the law deciding cases not on their legal merits, but on the politics e.g clowns like Rehnquist, Scalia Thomas and most of the Republican jurists on the supreme court over the last 50 years, none of whom I have any respect for.

The Democrats always appoint smart judges and the Republicans never do.

But the worst thing the Republicans did was fill the one African American seat held by the great Thurgood Marshall, with Clarence Thomas who is dumb, dishonest and wholly unfit for that job.
