You would be amazed at how many think sashaying under or around the bar is allowable.
I have said before that Section 230 isn't partisan or even arguable for those who understand the law.
There simply is no argument that can be made, the bar isn't that high either, there just is no argument.
And it has accretions, the finality of the TOU is evident to anyone involved in the process.
Section 230 has clear legal parentage and a clear legal purpose, hosts are not publishers.

By being a host you are compelled to action when laws are broken, a man's house is his house
A host has to decide and that decision is always part of that process, it is never black and white.
Every last person who utters a keystroke becomes a independent content provider, they are being hosted.
At no time do you own the home at which you are partying, the no dumping rule applies to all.
I love to string lots of long words together as much as the next person.
I intend for the most part that they make sense but that is clearly not always the case.
